Virginia vetoed. Virginia’s long-delayed adult-use cannabis market hit another major setback this week after Governor Abigail Spanberger vetoed legislation that would have launched regulated recreational cannabis sales beginning in 2027.

I share the General Assembly’s goal of establishing a safe, legal, and well-regulated cannabis retail marketplace in the Commonwealth. Virginians deserve a system that replaces the illicit cannabis market with one that prioritizes our children’s health and safety, public safety, product integrity, and accountability.  

As Virginia pursues a legal retail market, it is critical that we incorporate lessons learned by other states and ensure that our regulatory framework is fully prepared to provide strong oversight from day one. That includes clear enforcement authority and sufficient resources for compliance, testing, and inspections, and robust tools to crack down on bad actors who continue to profit from the illicit market.  

I greatly appreciate the patrons’ time crafting this important piece of legislation as well as our continued dialogue and collaboration to strengthen this framework ahead of the next legislative session. I remain committed to working with members of the General Assembly, stakeholders, and law enforcement to get this right.

Governor Abigail Spanberger’s official veto statement

While Virginia legalized adult possession and home cultivation in 2021, the state still lacks a legal retail market, leaving medical operators as the only licensed cannabis sellers and allowing the illicit market to continue filling demand.

Spanberger said the bill lacked the “timeline, structure, or resources” necessary for successful implementation, after lawmakers rejected her proposed amendments that included delaying launch dates, reducing the number of retail licenses, and increasing taxes.

The veto marks the third consecutive year a Virginia governor has blocked adult-use legislation, despite Democratic control of the state government and campaign promises supporting legalization.

Cannabis clarification. The Transportation Security Administration (TSA) is pushing back on widespread media reports suggesting a change in its cannabis policy, noting that its rules on medical cannabis have “not changed” despite recent headlines.

The agency emphasized that its screening procedures have long been focused on aviation security rather than drug enforcement, and that officers do not actively search for illegal substances. However, if cannabis is discovered during screening, it may still be referred to law enforcement, with final decisions left to the on-site officer and applicable federal, state, or local law.

The clarification comes after confusion sparked by recent updates to TSA’s “What Can I Bring?” webpage and broader reporting tied to federal cannabis policy shifts, including cannabis rescheduling, which some outlets mistakenly interpreted as a substantive change in airport screening rules.

TSA officials stressed that the website revisions were for clarity and do not reflect any policy shift, underscoring that medical cannabis allowances and enforcement practices remain consistent with longstanding guidance.
