Firearm fight. The U.S. Supreme Court ruled in favor of a cannabis user challenging a federal law that broadly prohibits firearm possession by unlawful drug users, finding that the government cannot automatically assume cannabis users are dangerous and therefore cannot impose a blanket gun ban without a stronger constitutional justification.

"Today's unanimous 9-0 decision makes it clear that the government cannot make it crime for people to own a gun, which the Supreme Court has held is a fundamental constitutional right, simply because they use marijuana."

Justices concluded that simply being a cannabis user, without evidence of intoxication while armed or other dangerous conduct, was not enough to justify stripping him of his gun rights.

Writing for the Court, Justice Neil Gorsuch emphasized that the decision is narrow and does not categorically bar future restrictions on individuals shown to pose a demonstrable risk, such as those actively intoxicated or with individualized evidence of danger.

The ruling reflects the Court’s continued application of its recent Second Amendment framework, requiring modern firearm restrictions to align with historical tradition, and signals limits on federal authority to impose blanket prohibitions on cannabis users who also possess firearms.

Delayed deal. Virginia is moving closer to launching a regulated adult-use cannabis market after Governor Abigail Spanberger announced a compromise agreement that would establish legal retail cannabis sales beginning July 1, 2027. The news comes less than a month after she vetoed similar legislation.

“We will do it in a way that protects consumers, targets the illicit market with clear enforcement and regulatory authority, and creates a more competitive market for small businesses and farmers. This is what good governing and collaboration look like — bringing people together, listening to families and public safety leaders, and focusing on solutions that are practical, enforceable, and in the best interest of Virginians. In the end, we all wanted to deliver a marketplace that the Commonwealth could implement effectively for the long-term. I’m proud to stand alongside these dedicated legislators, and to be working alongside them to deliver a marketplace built to last.”

The proposal, unveiled earlier this week, would give the Virginia Cannabis Control Authority (CCA) time to develop regulations, testing requirements, and oversight systems before the market opens. State leaders said the agreement is designed to strengthen public safety, curb illicit market activity, expand consumer protections, and create opportunities for small businesses and farmers.

Under the compromise, Virginia would authorize up to 350 retail cannabis licenses, increase the adult possession limit from one ounce to two ounces, and begin accepting license applications on February 1, 2027.

There would also be stricter youth protection measures, including child-resistant packaging requirements, restrictions on cartoon advertising, enhanced penalties for retailers that fail to verify age, and bans on products shaped like animals, fruits, vehicles, or humans. Retail stores would also be required to maintain a minimum distance of 1,000 feet from schools, hospitals, playgrounds, and drug treatment facilities.

On the economic side, the agreement restores protections for social equity and small business participants, including safeguards against predatory investment practices and additional support for microbusinesses. Cannabis tax revenue would be directed toward early childhood education, K-12 schools, behavioral health and substance-use programs, public health initiatives, and the Cannabis Equity Reinvestment Fund.

The proposal sets a 6% state cannabis excise tax to start, rising to 8% in 2029, while allowing local governments to impose an additional 1% to 3.5% local tax.

AI advancements. Cannabis technology giant Dutchie has unveiled “Consumer AI,” a new suite of AI-powered tools designed to help dispensaries automate operations, increase basket sizes, and improve customer engagement across phone, online, and in-store channels.

We're embedding AI into the places where retailers and consumers already engage, helping teams reduce manual work, uncover faster insights, and create more tailored shopping experiences in an increasingly competitive market."

The suite includes four integrated products:

  • Voice AI — an automated phone assistant that can answer customer questions and facilitate orders

  • Agentic Commerce — an AI shopping concierge that helps customers discover products, rebuild past orders, and complete purchases

  • Register Co-Pilot — equips budtenders with real-time recommendations, purchase history, and upselling prompts at checkout

  • Consumer Pulse — a sentiment analysis platform that aggregates surveys and online reviews to identify trends and operational issues

Dutchie says the tools are embedded directly into its existing POS and eCommerce ecosystem, allowing retailers to deliver more personalized experiences while reducing manual workloads. The company positioned the launch as a response to increasing competition and regulatory evolution in cannabis retail, arguing that AI-driven automation and customer intelligence will become critical differentiators as the industry matures.

Dutchie currently powers more than 6,500 cannabis businesses across North America and has processed over $100 billion in transactions.

🇺🇸 STATE OF THE INDUSTRY

Illinois: Governor JB Pritzker signed a law banning intoxicating hemp sales to anyone under 21 and shifting those products into the regulated cannabis system with stricter testing, packaging, and oversight rules while limiting sales to licensed dispensaries to improve consumer safety and industry accountability.

Michigan: Cannabis Regulatory Agency director Brian Hanna was elected president of the Cannabis Regulators Association, a national organization of state regulators, where he will help coordinate policy development, best practices, and regulatory standards across U.S. cannabis programs.

New York: An appeals court overturned a lower court ruling that had temporarily blocked state enforcement actions against hemp retailers, restoring the state’s authority to conduct inspections and raids under its cannabis regulations.

North Carolina: Lawmakers advanced a bill that would prohibit people under 21 from buying or possessing hemp-derived THC products, hemp gummies, intoxicating drinks, and kratom, while requiring retailers to verify age and imposing penalties for sales to minors.

Ohio: A federal judge temporarily blocked enforcement of the state’s intoxicating hemp restrictions for 10 hemp beverage companies, allowing them to continue selling federally compliant hemp-derived products for at least 14 days while their legal battle challenging the law proceeds.

Pennsylvania: A bill to create an independent Cannabis Control Board and shift oversight of medical cannabis and hemp products away from the Department of Health failed a floor vote, stalling the proposed regulatory overhaul.

The vertically integrated cannabis company disclosed that it separated its medical and adult-use cannabis retail business from its core operations and applied to uplist its shares to the New York Stock Exchange.

The mega multi-state operator expanded its cannabis footprint as it completed the acquisition of an equity interest in Maryland dispensaries and entered into a definitive agreement to acquire C21 Investments, strengthening its presence across multiple regulated U.S. cannabis markets.
