IRS. Despite the recent development indicating the Biden administration is poised to reschedule cannabis under federal law, the Internal Revenue Service (IRS) issued a statement reminding taxpayers that until a final federal rule is published cannabis remains a Schedule I controlled substance and Code Section 280E still applies. As it stands today, 280E means legal cannabis companies are subject to restrictive tax burdens and prohibited from deducting ordinary business expenses.
Although the law has not changed, some taxpayers are filing amended returns. The grounds for filing such claims vary, but these claims are not valid. The IRS is taking steps to address these claims. Section 280E disallows all deductions or credits for any amount paid or incurred in carrying on any trade or business that consists of illegally trafficking in a Schedule I or II controlled substance within the meaning of the federal Controlled Substances Act. This applies to businesses that sell marijuana, even if they operate in states that have legalized the sale of marijuana.
Last year, amid speculation about rescheduling, Jeff Schultz, a cannabis attorney at Foley Hoag said removing 280E would have a āwidespread material impact on the financial performance of every company in the industry, large and small, public and private.ā

DOT. According to comments from Secretary of Transportation Pete Buttigieg during testimony before the House Committee on Transportation and Infrastructure last week, cannabis rescheduling wonāt impact the U.S. Department of Transportationās authority to test for the drug.
Impairment is, of course, a major safety concern. Our understanding of the rescheduling of marijuana from Schedule I to Schedule III is that it would not alter DOTās marijuana testing requirementsā¦for private individuals who are performing safety sensitive functions subject to drug testing, marijuana is identified by name not by reference to one of those classes, so even if it moves in its classification, we do not believe that that would have a direct impact on that authority.ā
Buttigieg also maintained that the department is continuing to evaluate any indirect impacts rescheduling might have.

This comes on the heels of his proclamation that his administration is prepared to have cannabis reclassified from a Schedule I to a Schedule III drug.
